PIERS import data bolstered Zeta Espacial's claim that its U.S. distributor had not honored their exclusive agreement.

Zeta Espacial S.A., Barcelona-headquartered confectioners whose products include the legendary Pop Rocks and other fizz-in-your-mouth, carbonated candies, believed that its U.S. distributor was not honoring their exclusive distribution agreement. A lawsuit was duly filed and court dates scheduled. But instead of following a protracted course of litigation, Zeta's case was settled quickly in its favor, thanks to trade data assembled by PIERS.

"Zeta was able to present details about certain shipments, including the shippers and the consignees, at the initial hearing that made it clear the defendants did not comply with the distribution agreement," says Dorothy DeBurijn, head of Zeta's Corporate Intellectual Property Department. "They thought the whole matter over and came back to us with an offer to settle two weeks before the trial was to begin." The companies agreed on a €930,00 (approximately US$1,235,000) settlement in July 2004.
